Frein's prelim hearing ppd; 1 attorney withdraws

Accused cop killer Eric Frein will not appear in court for another month.


According to court documents, one of Frein's court-appointed attorneys -- Robert F. Bernathy -- asked to withdraw from the case, and a judge approved that motion.


Bernathy cited the fact that he is serving as the part-time chief public defender for Pike County,and his serving as Frein's attorney would impact the county defender's office.


Frein's preliminary hearing was originally scheduled for Dec. 9 and has been postponed until January 5, 2015 at 9 a.m. in Pike County.


Frein is accused of gunning down two state troopers on the night of Sept. 12, killing Cpl. Bryon Dickson and seriously wounding Tpr. Alex Douglass.


Frein surrendered to U.S. Marshal's Service on October 30 after a 48-day manhunt.


The 31-year-old was located in an open field near the former Birchwood-Pocono Airpark in Pocono Township, Monroe County.
